There are different way of discriminating against a person due to their sex:-

  • Direct Discrimination – this consists of treating one person less favourably than another, and doing so because of the persons sex
  • Indirect Discrimination – this exists where the effect of certain requirements, conditions or practices imposed by an employer or education provider has an adverse impact disproportionately on one group or other
  • Victimisation – this occurs where a person is treated less favourably because of action he or she is taking or has taken, is intending to take, or is suspected of taking, such as bringing proceedings against the employer under the Act, giving evidence or information relating to such proceedings, or doing any other act or by reference to the Sex Discrimination Act.
  • Harassment – a person subjects another to sexual harassment if:
    1. related to the sex of that of another person, a person engages in unwanted conduct that has the purpose or effect of violating the dignity, or of creating an intimidating, hostile, degrading, humiliating or offensive environment to another; or
    2. a person engages in any form of unwanted verbal, non-verbal or physical conduct of a sexual nature that have the purpose or effect of violating a persons dignity, or of creating an intimidating, hostile, degrading, humiliating or offensive environment for them; or
    3. on the ground of the rejection of or submission to unwanted conduct of the kind mentioned above, a person treats another less favourably than they would treat them had they not rejected, or submitted to, the conduct.
